TERMS AND CONDITIONS OF EMPLOYMENT The Employment Protection Code of Practice (Time Off) Order 1991
(1) in pursuance of section 6(1), (2)(b) and (5) of the Employment Protection Act 1975[1] (hereinafter referred to as"the Act" ) the Advisory, Conciliation and Arbitration Service (hereinafter referred to as"the Service" ) issued a Code of Practice on time off for trade union duties and activities which came into effect on 1st April 1978; (2) section 6(10) of the Act provides that the Service may from time to time revise the whole or any part of a Code of Practice issued under that section and issue the revised Code, and that section 6(3) to (9) shall apply (with appropriate modifications) in relation to such a revised Code; (3) in pursuance of section 6(3) and (10) of the Act the Service has revised the Code of Practice on time off for trade union duties and activities, has published a draft of the revised Code of Practice and has considered representations made to it about the draft; (4) in pursuance of section 6(4) and (10) of the Act the Service has transmitted the draft revised Code of Practice to the Secretary of State, who has laid it before both Houses of Parliament; (5) in pursuance of section 6(5) and (10) of the Act the draft revised Code of Practice has been approved by resolution of each House of Parliament and the Service is issuing the revised Code of Practice in the form of the draft;
1. This Order may be cited as the Employment Protection Code of Practice (Time Off) Order 1991 and shall come into force on 13th May 1991.
2. The revised Code of Practice on time off for trade union duties and activities issued by the Service under section 6(5) and (10) of the Act shall come into effect on 13th May 1991.
