ROAD TRAFFIC

The Merseyside Traffic Control System (Revocation) (No. 2) Order

Made 22nd March 1991
Coming into force 31st March 1991

    The Secretary of State for Transport, in exercise of the powers conferred by paragraph 10(7) and (8) of Schedule 5 to the Local Government Act 1985[1] and all other enabling powers, hereby makes the following Order:-
        1.    This Order may be cited as the Merseyside Traffic Control System (Revocation) (No. 2) Order 1991 and shall come into force on the 31st March 1991.
        2.—(1)  The Merseyside Traffic Control System (Revocation) Order 1991[2] is hereby amended as follows.

        (2)  In article 2-
       (a) for paragraph (1) there shall be substituted the following paragraph-
          "(1) The Merseyside Traffic Control System (Transfer) Order 1986[3]is hereby revoked." ;
       (b) after paragraph (1), there shall be inserted the following paragraph-
          "(1A) Article 3 of the Merseyside Traffic Control System (Transfer) Order 1988[4] shall be omitted."

        (3)  After article 3 there shall be inserted the following article-
        "3A. Subject to articles 4and 5, Part V of the Road Traffic Regulation Act 1984[5] shall have effect as from revocation date as if the Merseyside Traffic Control System (Transfer) Order 1986 had never been made."

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order is made in consequence of defects in the Merseyside Traffic Control System (Revocation) Order 1991. That Order purported to revoke the Merseyside Traffic Control System (Transfer) Order 1988 on 1st April 1991. The revocation provision is amended so that the 1988 Order is amended by the omission of article 3. Furthermore, an article is inserted in the previous Order to make it clear that the functions which were transferred to the Secretary of State by the Merseyside Traffic Control System (Transfer) Order 1986 are transferred to the respective Merseyside local authorities.
