REPESENTATION OF THE PEOPLE

The Returning Officers (Parliamentary Constituencies) (England and Wales) (Amendment) Order 1991

Made 31st January 1991
Coming into force in accordance with article 1(2) and (3)

    In exercise of the powers conferred upon me by section 28(1)(b) of the Representation of the People Act 1983[1], I hereby make the following Order:
        1.—(1)  This Order may be cited as the Returning Officers (Parliamentary Constituencies) (England and Wales) (Amendment) Order 1991.

        (2)  Subject to paragraph (3) below, this Order shall come into force on 15th February 1991.

        (3)  Article 3 below shall come into force on the issue of a proclamation by Her Majesty summoning a new Parliament, except that for the purposes of prceedings prelimenary or relating to a parliamentary election held after the issue of that proclamation, it shall come into force on 15th February 1991.
        2.    Paragraph (3) of article 1 of the Returning Officers (Parliamentary Constituencies) (England and Wales) Order 1983 (meaning of constituencies)[2] shall be omitted.
        3.    In Part I of Schedule 3 to the Returning Officers (Parliamentary Constituencies) (England and Wales) Order 1983 (acting returning officers for county constituencies in England) the entry in respect of "Milton Keynes" shall be omitted and after the entry in respect of "North East Derbyshire" there shall be inserted in column 1 of that Part the words "North East Milton Keynes" and in column 2 the words "Milton Keynes".

EXPLANATORY NOTE

(This note is not part of the Order)
    Article of this Order removes a definition of "constituencies" in the Returning Officers (Parliamentary Constituencies) (England and Wales) Order 1983 which is now inaccurate.
    Article 3 of this Order makes provision consequential on the changes made by the Parliamentary Constituencies (England) (Miscellaneous Changes) Order 1990 (S.I. 1990/1307). It designates the registration officer for the Borough of Milton Keynes as the acting returning officer for the county constituency of North East Milton Keynes which will be created by the Order reffered to above. No such designation is necessary as respects the borough constituency of Milton Keynes South West because section 28(1)(a) of the Representation of the People Act 1983 applies.
