MARINE POLLUTION

The Merchant Shipping (BCH Code) (Amendment) Regulations 1990

Made 19th December 1990
Coming into force 1st January 1991

    The Secretary of State for Transport, in exercise of the powers conferred on him by article 3 of the Merchant Shipping (Prevention and Control of Pollution) Order 1987[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:
        1.    These Regulations may be cited as the Merchant Shipping (BCH Code) (Amendment) Regulations 1990 and shall come into force on 1st January 1991.
        2.    The Merchant Shipping (BCH Code) Regulations 1987[2] are hereby amended as follows:
       (i) in regulation 1(2)—
       (a) amend the definition of "1974 SOLAS Convention" by adding at the end "and as further amended by amendments adopted on 21st April and 28th October 1988 and 11th April 1989 by the Maritime Safety Committee of the International Maritime Organization";
       (b) in the definition of "Annex II" after "5th December 1985" add "and on 17th March 1989";
       (c) in the definition of "BCH Code" replace "(1986 Edition)" by "(1990 Edition)";
       (d) in the definition of "Control of Pollution by Noxious Liquid Substances Regulations" after "1987[3]" add "as amended";
       (e) amend the definition of "MARPOL 1973/8" by adding at the end "and as further amended by amendments adopted on 17th March 1989 by Marine Environment Protection Committee of the International Maritime Organization";
         (ii) in regulation 2(3) add after "Merchant Shipping (IBC Code) Regulations 1987" add "as amended"[4];
         (iii) in regulation 11 after "the Merchant Shipping (BCH Code) Regulations 1987" add "as amended";
         (iv) in the schedule in Tables 1 and 2 in the heading to Column 1 for "(1986 Edition)" substitute "(1990 Edition)".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Merchant Shipping (BCH Code) Regulations 1987.
    They bring into effect amendments which have been adopted by the Marine Environment Protection Committee of the International Maritime Organization (and also by its Maritime Safety Committee). The adopted amendments rationalise and add to the lists of substances appended to Annex II of MARPOL 73/78 with some changes of categorisation. Additional substances have been added to Chapters VI and VII of the BCH Code largely from pollution aspects and there has been some change in existing categorisation and some editorial amendment. A 1990 edition of the BCH Code has been produced.
